Kohima Bar Association Exposes Police-Advocate Corruption Nexus
The Kohima Bar Association (KBA) has flagged a growing illicit alliance between advocates and the police in Nagaland, which it claims undermines the criminal justice system and violates the personal liberties of the accused. This unethical practice, the KBA asserts, is also prevalent in other states.
KBA highlights that Article 22 of the Indian Constitution allows the accused to choose their advocate, and the Legal Services Authorities Act, 1987, provides legal aid for those unable to afford it. However, these rights are being systematically violated. The KBA alleges that police and jail officials force accused individuals to hire specific advocates for bail, often keeping Vakalatnamas (legal documents authorizing an advocate) of “handpicked” advocates.
The accused are coerced into appointing these advocates, who then share a percentage of their fees with the police—a clear case of corruption. This practice imposes unnecessary financial burdens on the accused and their families, and complicates efforts if relatives attempt to engage different advocates later.
Such actions, according to KBA, not only tarnish the integrity of investigations but also violate Article 22 and the nobility of both professions. The KBA emphasized that public servants involved in these malpractices are punishable under the Prevention of Corruption Act, 1988, and subject to disciplinary action under the Nagaland (Discipline and Appeal) Rules, 1967. Similarly, implicated advocates may face disbarment under the Advocates Act, 1961.
The KBA has raised this issue with Nagaland’s Director General of Police (DGP), seeking stringent action against the corrupt officials. The association has also issued a stern warning to its members engaging in such malpractices and encouraged anyone aware of these activities to report them.
KBA President, Kekhriengulie, pointed out that many people have fallen victim to this nexus, emphasizing the need to streamline the criminal justice system to ensure fair delivery of justice. He stressed that any collaboration between police and advocates compromises the system’s integrity. The association is committed to upholding ethical standards and ensuring justice is delivered fairly.
